Description
This paper provides answers to the following questions –
(a) Explain the requirements of an enforceable Award under the Arbitration Act 2005.
(b) State the grounds and circumstances on which the court can set-aside the arbitral Award with reference to decided cases. Make reference to decided cases.
(c) How may an arbitral Award be enforced in Malaysia. Make reference to decided cases.
(d) Explain the circumstances under which a High Court may determine a question of law arising either in the course of the arbitration or arising out of an award.
